Future planning

Many people will make a will for themselves that will include provision for their vulnerable child.

This provision may be to set up a discretionary trust (sometimes called a vulnerable person’s trust or a disabled person’s trust), managed by at least two trustees (brothers, sisters or other family members, but often someone independent, too). This Trust can last for up to 125 years (or be brought to an end sooner i.e. on the death of the vulnerable person) and has a minimum of two beneficiaries – one of which will be the vulnerable person, who will be the primary beneficiary. This kind of trust pays out £3,000 a year to all beneficiaries plus discretionary payments, as instructed by the trustees. A Will draws up the framework for the trust and will include a ‘supporting letter’, which is known as an ‘expression of wishes’. This will detail how the will-holder wishes the trust to operate

Power of attorney is a vital tool to ensure that, post-18, parents/carers have the legal power to manage the financial and/or health affairs of the vulnerable person. Power of attorney is very important, too, for parents and carers, and it is important to set this up as soon as possible. In the unlikely event that something should happen to you suddenly (as a parent or carer), you will want to ensure that you have made provision for someone you are happy with to be making decisions on your behalf, so that they can also support your vulnerable child.
